Forestry and Land Scotland (FLS) is a new executive agency of the Scottish Government, established on 1 April 2019 under the Forestry and Land Management (Scotland) Act 2018 (“the 2018 Act”). The agency is led by a Chief Executive directly accountable to Scottish Ministers and the Scottish Parliament.
FLS recognises the value to local communities and communities of interest of our national forests and land, both through what can be delivered within our national forests and land, and how that involvement can strengthen and empower communities.
The Community Empowerment (Scotland) Act 2015 provides a statutory right for community bodies, where they consider they can make better use of public land or buildings, to take more control through asset transfer. The Act and subsidiary Asset Transfer Regulations set out how public authorities in Scotland will assess requests transparently against a specified list of criteria and agree the request, unless there are reasonable grounds for refusal.
FLS launched the Community Asset Transfer Scheme (CATS) for Scotland’s national forests and land on 23 January 2017, to meet our new legal obligations under the Act. CATS sets out FLS processes for handling statutory Asset Transfer Requests, and how we will continue to support broader objectives on social housing, conservation and community engagement.
Key responsibilities/Purpose and role of non-executive post holders
As a member of the CATS Evaluation Panel for Scotland’s national forests and land you will assess the benefits and impacts of Asset Transfer Requests and provide advice to the Chief Executive of FLS, and other public bodies where requested.
Key work areas will be:
·To provide independent and impartial advice to FLS on statutory and non-statutory applications to CATS.
·To review and comment on all papers relating to Asset Transfer Requests.
·To engage positively in debate and be a full partner on the Panel, acting in the interests of the aims of the CATS and taking collective responsibility for recommendations.
·To analyse and evaluate Requests taking into account the aims of the Community Empowerment (Scotland) Act 2015 to empower communities and reduce inequalities of outcome which result from socio-economic disadvantage, and the obligation to make Decisions in a manner which encourages equal opportunities.
·To carry out visits to sites which are the subject of a Request
·To attend CATS Evaluation Panel meetings up to 4 times a year to evaluate and make recommendations to FLS on Requests.
You should also be able to offer experience in one (or more) of the following areas:
·Business planning and financial management.
Terms of appointment
This appointment will be for three years, effective from appointment date and there is the possibility of re-appointment for an additional period. CATS Evaluation Panel members are appointed by, and accountable to, the Chief Executive of FLS. Forestry and Land Scotland’s CATS Evaluation Panel will each meet up to four times per year (in certain circumstances Asset Transfer Requests may also be considered by email or phone). All of the above meetings will usually be held in Edinburgh but may occasionally take place elsewhere. Non-executive post holders are asked to commit to up to ten days per year to this work, for which we will pay a daily fee of £250 and reasonable travel and other expenses.
